OREA Form 201 Seller Customer Service Agreement

This is a customer service agreement between the seller and the real estate brokerage. This Form 201 is used when the property is not listed in MLS in Ontario, and the brokerage provides customer service to the home seller. It is a non exclusive agreement between the real estate brokerage and the home seller for a specific buyer.

Main Clauses Highlights

COMMISSION

  • The home seller will pay the realtor fees to the real estate brokerage if the property is successfully sold by the agent.
  • The Holdover Period time clause extends the seller's obligation of commission after the expiration of this agreement. 
  •  The seller only owes the commission discrepancy if there is a new real estate agent involved.

DEPOSIT

Real estate deposits will be held in the brokerage trust account. The brokerage can use it to pay for the commission after the closing.  

REPRESENTATION AND CUSTOMER SERVICE

The brokerage has explained the relationship between seller and agent, the concepts of representation, and customer service.

FINDER’S FEE

The seller acknowledges that the seller brokerage may take other incentives, referral fees, or reward

INDEMNIFICATION AND INSURANCE

The seller will not claim against the agent/brokerage if there are any damages during showings. The seller’s property is properly insured.

FAMILY LAW ACT

The Seller hereby warrants that spousal consent is not necessary.

VERIFICATION OF INFORMATION

The seller allows the brokerage to obtain information to facilitate the transaction.
